
Melanie S. Bailey
Burg Simpson shareholder Melanie Bailey is a highly skilled and experienced attorney who is committed to protecting the best interests of those who have been harmed by the negligence of another party. A dedicated advocate for her clients, Melanie fights to maximize financial recoveries, and provide her clients with the best possible outcome to their legal matters.
Melanie is a member of the firm’s Cincinnati office and practices in the areas of complex civil litigation, pharmaceutical and general products liability, multi-district litigation, personal injury, wrongful death, and class action litigation. During her tenure at Burg Simpson, Melanie has devoted time to litigating defective medical devices cases and pharmaceutical cases. She has been extensively involved in multi-district litigation (MDL) cases such as Ortho Evra, contaminated Heparin, Yasmin/Yaz, Depakote, Fosamax, Elmiron and Tepezza. In January 2021, Melanie was appointed by the Hon. Brian M. Martinotti to serve in a leadership position on the Plaintiffs’ Steering Committee in the In re Elmiron (Pentosan Polysulfate Sodium) Products Liability Litigation, (MDL 2973) pending in the District of New Jersey.
Melanie also has extensive experience in class action litigation. Most recently, she has been involved in consolidated class action litigation arising from the derailment of a Norfolk Southern train in East Palestine, Ohio, pending before the Hon. Benita Y. Pearson in the Northern District of Ohio. Melanie was appointed a Co-Chair of the Law & Briefing Committee in the East Palestine litigation. In 2024, after more than a year of contentious litigation, a $600 million dollar class action settlement was reached and approved by Judge Pearson. Melanie is continuing her work in Law & Briefing to assist in responding to an appeal of the settlement. Melanie is also currently handling a class action lawsuit against Ambetter Insurance and is investigating consumer-based complaints about the insufficiency and inaccuracies of Ambetter’s online directory of network providers. In 2006, Melanie was court appointed Class Counsel in a class action employment case on behalf of Wal-Mart employees in the state of Kentucky.
Melanie S. Bailey earned a Bachelor of Arts Degree from Northern Kentucky University, cum laude, and a Juris Doctorate Degree from Salmon P. Chase College of Law, cum laude.
