Toyota and Lexus Recall

Colorado, Wyoming and New Mexico

Burg Simpson is currently seeking monetary recovery for residents injured by affected cars.

Since September 2009, Toyota® has been forced to recall more than 7 million vehicles in the US as a result of two dangerous defects, both of which have the potential to cause the accelerator pedal in some models to "stick" in the down position.

To date, the US National Highway Traffic Safety Administration (NHTSA) believes that these defects may have been responsible for more than 52 deaths in auto accidents nationwide. Federal regulators have received thousands of consumer complaints regarding unintended and or sudden acceleration in Toyota® vehicles going back as far as 2002, but until recently the issue has received little media attention.

All that changed in August 2009, following the tragic death of an off-duty California Highway Patrol officer and three members of this family, when the Lexus® ES 350 sedan he was driving, unexpectedly accelerated into the back of an SUV and burst into flames. In September 2009, Toyota® attempted to blame the causes of the crash on a problem with the car's floor mats, and issued a recall (“Floor Mat Entrapment”) for more than 4 million of its most popular models - an explanation the NHTSA later characterized as "inaccurate and misleading."

In response to a further increase in the number of unintended acceleration accidents reported to federal regulators, Toyota® issued a second recall ("Pedal") in early 2010, affecting more than 2.5 million vehicles. This second life-threatening defect related to the manufacture of a faulty accelerator pedal and its potential to get stuck in the wide-open position.

  • Toyota Corolla: 2009-2010 (if VIN starts with letter "J", Corolla is not affected)
  • Sequoia: 2008-2010
  • Matrix: 2009-2010
  • Toyota RAV4: 2009 - 2010 (if VIN starts with letter "J", RAV4 is not affected)
  • Toyota Sienna: 2009
  • Toyota Land Cruiser: 2009
  • Toyota Yaris: 2009
  • Toyota Prius: 2004 – 2009
  • Toyota Avalon: 2005 – 2010
  • Toyota Tundra: 2007 – 2010
  • Lexus ES 350: 2007 – 2010
  • Lexus IS 250 and IS 350: 2006 – 2010
  • Pontiac Vibe: 2009-2010

Reports have been received of problems in earlier models, and other models, including the RAV4, Tacoma, Sienna, Camry Solara, and the Lexus ES 300 and 330.

Despite, intensive media scrutiny, numerous public apologies by high ranking Toyota® officials and pressure from federal regulators, Toyota® has been extremely slow to acknowledge and fix these potentially lethal defects. Furthermore, many automotive experts believe that despite assurances to the contrary, Toyota® still may have not correctly identified the true cause of the problem in all of its vehicles.
