Law Week Names Attorney Diane Smith One of Colorado's "Top Women"
Attorney Diane Smith of Burg Simpson Eldredge Hersh & Jardine, PC was recently named by Law Week as one of Colorado’s “top women.” The August 4, 2008 edition of the publication notes one of Smith’s most recent legal successes: the recovery of benefits for 208 RTD employees in a class action suit.
Janet G. Abaray appointed to the Executive Committee for the Heparin Product Liability Multi-District Litigation
Burg Simpson Eldredge Hersh and Jardine, P.C congratulates our colleague and shareholder, Janet G. Abaray, on her appointment to the Executive Committee for the Heparin Product Liability Multi-District Litigation. Ms. Abaray was appointed to this position by The Honorable James G. Carr, federal judge presiding over the Heparin Product Liability Multi-District Litigation in the Northern District of Ohio.
The Executive Committee is charged with coordinating the responsibilities of the Plaintiffs' Steering Committee (PSC) including:
- Scheduling meetings of the PSC;
- Keeping minutes or transcripts of those meetings;
- Appearance at periodic court noticed status conferences;
- Other necessary administrative or logistic functions of the PSC;
and any other duty as the Court may order. The PSC is responsible for the coordinated and consolidated conduct of all discovery on behalf of, and for the benefit of, all plaintiffs.
Peter W. Burg and Scott J. Eldredge Recognized as Fellows of the Litigation Counsel of America
The Litigation Counsel of America is a trial lawyer honorary society established to reflect the new face of the American bar. Membership is limited, representing less than one-half of one percent of American lawyers, and is by invitation only. Membership includes placement of a maximum of 3,500 Fellows, who are selected and invited into Fellowship after being evaluated on effectiveness and accomplishment in litigation and trial work, along with ethical reputation. Mr. Michael S. Burg and Mr. David P. Hersh are also members of this distinguished group.
Another Appointment for Peter W. Burg
Burg Simpson Eldredge Hersh and Jardine, P.C is pleased to announce that Peter W. Burg has been appointed as Co-chair of the Plaintiffs' Steering Committee and the Executive Committee for the Gadolinium-Based Contrast Agents Product Liability Multi-District Litigation.
Mr. Burg was appointed to these leadership positions by The Honorable Dan A. Polster, federal judge presiding over the Gadolinium-Based Contrast Agents Product Liability Multi-District Litigation in the Northern District of Ohio. The PSC reports directly to Judge Polster, and is responsible for conducting pre-trial proceedings on behalf of all plaintiffs who have cases in the MDL.

Simpson Tribute
Former U.S. Sen. Al Simpson, left, shares a laugh with his brother Pete following the ribbon-cutting ceremony at the University of Wyoming's new Simpson Plaza. The plaza, located on the west side of the Wyoming Union, honors the many contributions the Simpson family has made to UW, including Al's recent efforts as chair of the university's record-breaking fundraising campaign, which generated $204 million over five years to bolster UW academic and athletic programs.
Simpson a member of the Bipartisan Iraq Study Group
Earlier this year The Iraq Study Group was formed under the auspices of the congressionally chartered U.S. Institute of Peace. Alan Simpson is a member of this respected group of Americans who will provide an independent look at the way forward in Iraq. It has been said that the members of this group are more concerned about our country than their respective political parties. In addition to Al Simpson, former senator from Wyoming, members of the group are former CIA Director Robert Gates recently appointed Defense Secretary; former New York Mayor Rudy Giuliani; former Clinton adviser Vernon Jordan; former Clinton Chief of Staff Leon Panetta; former Clinton administration Defense Secretary William Perry; and former Senator Chuck Robb.
Led by former Secretary of State James Baker and former congressman Lee Hamilton, the group will focus "fresh eyes" on the war debate. This group of long-time public servants have been asked to
- Assess the current and prospective situation on the ground in Iraq
- Assess the impact of the current and prospective situation on the surrounding region, and to
- Assess the consequences of the current and prospective situation on United States interests.
In other words, is the war going well or poorly and what are the ramifications if the U.S. mission were to fail.
Two options under discussion at one point included greater cooperation with Iran and Syria and a phased withdrawal of U.S. troops, which would require a major policy shift by the current administration.
The group's findings are not expected until some time after Thanksgiving.
